Terms of Service and Sale of Digital Content
Effective date: 17 July 2026
These Terms govern the use of the Cold Execution service operated by TriCode Michał Powałka, the conclusion of distance contracts and the supply of digital content and digital services. They do not limit any Consumer rights that cannot be excluded under mandatory law.
1. General provisions
These Terms govern the use of the Cold Execution service at https://coldexecution.com, account creation, the conclusion of distance contracts, the supply of digital content and digital services, the use of the software, Market Room, educational materials, TradingView indicators, support and the subscription programme.

These Terms are made available free of charge before the contract is concluded, in a form that allows them to be saved and reproduced. You must not provide unlawful content or use the Service in breach of law, good practice or third-party rights.
2. Definitions
- Bot / Trend Follow — trading-automation software designed to run in a cTrader or MetaTrader environment, installed and run on the user's side.
- Digital content — a file, software, indicator, documentation, configuration or other content supplied in digital form.
- Digital service — access to the account, panel, Market Room, updates, support or another service provided online.
- Market Room — general, non-personalised commentary, scenarios, journal and educational materials about markets and the trading process.
- Subscription — paid, automatically renewing access for the stated billing period.
- In-house products — bots, indicators and materials created or released by Cold Execution.
- Third-party products — products of other providers that may be offered for a separate fee.
- Consumer — a natural person entering into a contract not directly related to their business or profession; Consumer provisions also apply to a sole trader benefiting from consumer protection where the law so requires.
3. Scope of the offer
As of the effective date, the Service offers three monthly Subscription plans. The current price, taxes and full plan contents are always shown before you place an order.
Third-party creators' products are not automatically included in the Full Access plan and may require a separate payment. As the catalogue grows, the plan price may change under the price-change rules.
- Market Room — USD 49 / month — access to the group, regular commentary and market scenarios, and the trading journal.
- Trend Follow — USD 99 / month — Market Room plus a licence for the main Trend Follow bot and onboarding support.
- Full Access — USD 199 / month — Trend Follow, Market Room, the specified TradingView indicators and access to in-house bots and indicators included in the plan.
4. Account and technical requirements
Selected features require a user account, a valid email, Internet access and compatible devices and software. The Bot requires a broker account supporting cTrader or MetaTrader, the relevant application, a valid platform ID (cTrader ID or MetaTrader ID) and, for continuous operation, a computer or VPS running during the required hours. TradingView indicators may require a separate TradingView account.
You are responsible for accurate data, credential security, compatibility of your environment, broker conditions and parameter configuration. One purchase/licence may be linked to one platform ID unless the offer states otherwise.
5. Conclusion of contract and start of supply
The contract is concluded once you place an order, accept the required documents and payment is successfully confirmed. You receive confirmation on a durable medium, in particular by email.
Where a Consumer wants immediate access before the 14-day period expires, checkout includes separate statements regarding: (a) starting the supply of digital content and losing the right of withdrawal once supply begins, and (b) starting a digital service before the withdrawal deadline and the obligation to pay a proportionate amount if withdrawing.
6. Nature of the Bot and user control
The Bot automates the execution of rules according to your configuration, including opening and closing positions, setting stop loss, take profit, trailing, partial closes and other parameters. The exact scope depends on the version and configuration.
Cold Execution has no access to your broker account, balance, trading history or funds and cannot deposit, withdraw or manually manage the account. The platform ID is used for licence management.
7. Market Room and educational materials
Market Room serves solely as a trading journal and a presentation of the author's personal opinions, observations and general scenarios. The published content is not, and must not be treated as, individual investment advice, a personalised recommendation, an offer, invitation or call to buy or sell a financial instrument.
The author may hold positions or trade the instruments discussed. The materials reflect only the author's own approach, not an assessment of suitability for a specific user. Each user decides independently whether and how to use the information and acts at their own responsibility and risk.
8. Payments, taxes and renewals
Payments are handled by an external payment provider indicated at checkout. Prices may be shown in USD, and the final amount, tax (VAT or other) and settlement currency are shown before purchase.
The Subscription renews automatically each month until cancelled. You authorise the payment provider to charge the following fees. Cancellation stops future renewals and generally does not shorten the paid period.
If a payment fails, access may be limited or suspended. Cold Execution may retry the charge in line with the payment provider's rules.
9. Changes to prices and plan scope
Cold Execution may change the prices, names and scope of plans for product, technical, legal or economic reasons. A change does not affect an already-paid period. You will be informed of a change to the next renewal price with appropriate notice, generally no less than 30 days, and may cancel the Subscription before the change takes effect.
Access to future in-house products covers only products expressly added to the plan. It is not an indefinite guarantee of every future product, the retention of every feature or a fixed price.
10. Updates, compatibility and availability
Cold Execution may provide updates, including security and compatibility updates. You should install required updates. Missing updates may limit correct operation.
We do not guarantee uninterrupted availability or compatibility with every platform version, broker, symbol, account type, VPS or setting. Planned works, outages, changes to third-party services and events beyond reasonable control may temporarily limit access.
11. Support
Support is provided through channels shown on the Website, in particular contact@coldexecution.com, on a best-efforts basis. We do not guarantee a specific response time unless separately agreed.
Support does not include account management, individual investment advice, covering losses, guaranteed setup with every broker or the creation of an individual strategy.
12. Permitted use and prohibitions
- use only for your own purposes and within the purchased plan;
- no sharing of files, account, licence, confidential configurations or materials with unauthorised persons;
- no decompilation, reverse engineering, circumvention of protections, removal of markings or copying of logic;
- no resale, sublicensing, rental, public distribution or use in a service for third parties without written consent;
- no breach of the rules of the broker, cTrader, MetaTrader, TradingView, the payment provider or the law;
- no presenting the product as guaranteeing profit, being safe or risk-free.
13. Suspension and termination
Cold Execution may suspend or terminate access in the event of non-payment, licence breach, fraud, chargeback, support abuse, a security threat or a breach of law. Where possible you will be informed and given the chance to remedy the breach, unless immediate action is justified.
When the Subscription ends, the right to use features requiring an active licence expires. Provisions on intellectual property, liability, confidentiality, payments and disputes survive.
14. Complaints and conformity of digital content/services
Complaints may be sent to contact@coldexecution.com or in writing to 72/11 Aleja „Solidarności”, 00-145 Warsaw, Poland. A complaint should include contact details, a description of the problem, the purchase date and the requested remedy.
Cold Execution responds to a Consumer complaint within the period required by law, generally within 14 days. Consumers have statutory remedies where digital content or a digital service does not conform to the contract. These Terms do not limit rights that cannot be excluded.
15. Risk and no advice
Trading financial instruments, including CFDs, forex, indices, metals and derivatives, carries high risk and may lead to the loss of part or all of your capital. Automation does not remove risk.
Cold Execution provides software, general educational materials and non-personalised commentary; it does not provide portfolio management and does not execute orders on your account. Backtests, historical results, screenshots and live examples do not guarantee future results.
No marketing, support or community message may be understood as a guarantee of profit, a specific win rate, drawdown or income. Testing on a demo account is recommended, and you should use only capital whose loss does not threaten your financial situation.
16. Liability
To the fullest extent permitted by law, Cold Execution is not liable for trading decisions, lost profits, market losses, drawdown, margin calls, slippage, spread, broker fees, taxes, outages of the broker, platform, TradingView, VPS, payment provider or Internet, or incorrect user configuration.
Towards businesses, liability for indirect damages and lost profits is excluded, and Cold Execution's total contractual liability is limited to the net fees paid by that business for the last 3 months preceding the event, except where such a limitation is legally impermissible.
Nothing excludes liability that cannot be excluded under mandatory law.
17. Governing law and disputes
These Terms are governed by Polish law. The choice of Polish law does not deprive a Consumer of the protection of mandatory provisions of the country of their habitual residence.
Disputes with businesses are subject to the court competent for Warsaw, unless mandatory law provides otherwise. Consumers may use applicable out-of-court dispute mechanisms (including the municipal/district consumer ombudsman and the Trade Inspection); Cold Execution's participation in a specific ADR procedure may depend on separate consent or a legal obligation.
18. Changes to the Terms
Cold Execution may change these Terms for a valid reason, in particular changes in law, the offer, technology, security, payments or the way services are provided. Active subscribers will be informed before a material change takes effect. Where a change materially and negatively affects a continuous service, you have the rights required by law.
